1. Who we are
This website is operated by Ashmont Pinnacle Advisory FZ-LLC, a free zone company licensed in the RAK Economic Zone, Ras Al Khaimah, United Arab Emirates. In these terms, "we", "us" and "the firm" mean that company, and "you" means the person using this website.
2. Using this website
You may read this website, and print or save pages from it, for your own use. You may not copy it, or any substantial part of it, to publish elsewhere or to offer a competing service. You may not attempt to interfere with the site, its hosting, or the security of either.
3. This website is not advice
The information on this website is general. It describes what the firm does. It is not legal, tax, accounting, investment or property advice, and no page here should be relied on in place of advice given to you on your own facts. We give advice only under a written engagement, and only to the client named in it.
4. How we take on work
Sending us a message through this website does not create a client relationship, and nothing on this site is an offer to act for you. We act only once we have agreed the work, the fee and the terms in writing, and completed our own checks on identity and on the source of funds where those apply.
5. Fees
Fees are agreed in writing before work begins, either as a fixed amount for a defined piece of work or at an agreed rate. Expenses incurred on your behalf, including government and registry charges, are charged at cost. Invoices are payable within the period stated on them, and work may be paused where an invoice is overdue.
6. Confidentiality
We keep client information confidential, and we use it only for the work you have asked us to do. We may disclose it where the law requires it, where a regulator or authority compels it, or where you have asked us to. Our advisers and service providers are bound by the same obligation.
7. Your material and ours
You keep ownership of the documents and information you give us. We keep ownership of the templates, models, working methods and software we use to produce our work, including our own products. Where we deliver a report or a document to you, you may use it for the purpose it was prepared for.
8. Our software products
Ledgard, Lodeward, Cardward and Turnward are separate products, each with its own terms and its own privacy notice, which apply when you use them. Nothing in these terms replaces those. Where a product produces a report or a figure, it is information for you to act on, not advice, and not a valuation.
9. Links to other sites
This website links to sites we do not control, including our own product sites and third-party services. We are not responsible for their content, their availability, or what they do with information you give them.
10. Availability
We aim to keep this website available, but we do not promise that it will be uninterrupted or free of error, and we may change or withdraw any part of it without notice.
11. Liability
Nothing in these terms limits liability for fraud, or for anything else which cannot lawfully be limited. Subject to that, we are not liable for loss arising from use of this website, and our liability for advisory work is governed by the engagement letter for that work, which sets out any agreed limit.
12. Data protection
How we handle personal information is set out in our privacy policy, which forms part of these terms.
13. Changes to these terms
We may change these terms. The version published on this page is the one that applies, and the date above shows when it last changed.
14. Governing law
These terms, and any dispute arising from them or from your use of this website, are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah, and are subject to the exclusive jurisdiction of its courts.
